What Property You May be Able to Exempt

Chapter 7 bankruptcy is also known as liquidation. This means a trustee will sell your non-exempt assets to pay off as much of your debt as possible. However, that does not mean you will lose everything. Minnesota law allows property exemptions in Chapter 7 bankruptcy cases.

Some of the most common exemptions include:

  • Property that is used as a residence
  • Burial lots
  • Motor vehicles
  • Personal property
  • Professional tools
  • Wages
  • Government benefits
  • Alimony, child support, and separate maintenance
  • Retirement and pensions
  • Life insurance

All of these exemptions of specific dollar limits in the state of Minnesota. What you are able to exempt depends on your financial circumstances. If you are ready to talk about your options for filing for Chapter 7 bankruptcy, contact our Minnesota law firm today. Our attorneys will be straightforward with you about what to expect, and we will be honest if we feel bankruptcy is not the best route for you.

How Does Chapter 7 Bankruptcy Work?

The first step in a Chapter 7 bankruptcy case is to meet with an attorney to determine whether you qualify for this type of bankruptcy. There are strict income limits that are based on the state’s median income level.

Here are some possible steps you may need to take to file for a Chapter 7 bankruptcy:

  • Complete credit counseling
  • File a petition with the Bankruptcy Court
  • File additional documentation regarding your assets and liabilities, income and expenditures, financial affairs, and other information
  • Provide a copy of your tax return for the most recent year

The Bankruptcy Court will appoint a trustee to liquidate any nonexempt assets and oversee the case. The trustee will pay unsecured creditors with proceeds from the sale of nonexempt assets. In many cases, the Bankruptcy Court will issue a discharge order. A discharge releases you from most debts and stops creditors from pursuing you any further. This typically happens 60 to 90 days after the creditors’ meeting.
