Does North Dakota Impose a Statute of Limitations on Injury Claims? 

Yes. In North Dakota, the general statute of limitations for filing a personal injury lawsuit is six years from the date of the injury (see N.D. Cent. Code § 28-01-16). This applies to most personal injury cases like car accidents, slip-and-falls, and injuries caused by defective products.

However, it's important to note some exceptions:

  • If you're filing a wrongful death suit, the statute of limitations is only two years from the date of death.
  • For medical malpractice claims, the statute of limitations is generally two years from the date you discovered your injury or should have reasonably discovered it, not necessarily the date of the incident itself.
  • If your personal injury claim involves the state of North Dakota, the statute of limitations is only three years, and you must also file a notice of claim with the relevant agency within 180 days of discovering your injury.
